NOTES ON DOCUMENTATION OF CERTAIN CERTIFICATE

1. Marital Status Certificate:

 

Single Status Certificates are issued by local  "Births, Deaths and Marriages Registration". In case an applicant has got married in the past, he (or she ) is advised to present a death certificate of the past spouse, a divorce certificate or a court degree nisi of dissolution of marriage. All the above mentioned documents should be duly authenticated by Australian Department of Foreign Affairs and Trade or its representative offices in various states, before they can be further authenticated by the Consular Section of this Embassy.

 

If either party to a previous marriage is a Chinese citizen and that marriage was terminated by a court verdict outside China, please also enclose a written statement by a Chinese People's Court in acknowledgement of the legal power of the verdict. To obtain the written statement, a copy of the court verdict should be first duly certified and authenticated and then forwarded to the Chinese People's Court with a request for action.

 

The Marital Status Certificate should be duly authenticated by the Australian Department of Foreign Affairs and Trade or its representative office in the state of your residence before being submitted to the Chinese Embassy/Consulates for legalization within 3 months time from its date of issue.

 

When authenticated by Chinese consular posts, the MSC shall have a validity of 6 months for use in China.

 

2. Papers Relating to Adoption of Chinese Children:

Please consult your State or Territory Welfare Department or licensed inter-country adoption agency for procedural and other specific details. Required documents are as follows:

 

Adoption Application/Form to adopt a child from China;

 

Certified Birth Certificate(s);

 

Marital Status Certificate;

 

Certificate(s) of Professional & Employment Status, Income and Property;

 

Health Examination Certificate(s);

 

Police Checks on criminal record;

 

Certificate of Approval for the Inter-country Adoption by the relevant State Adoption Authorities; and Family Assessment Report.

 

3. Authorization, Power of Attorney and Declaration:

 

Inheritance, Housing Transfer: Relevant supportive documents, such as Titles Deeds and Kinship Certificate, are required.

 

4. Representation in Divorce Proceedings: Applicant's Authorization or Power of Attorney delegating a Third Party to act in his/her behalf must be done together with a written statement to sue or respond.
